PRIVACY POLICY AND PROCESSING OF PERSONAL DATA

We thank you for trusting in Mainvision and we want to inform you, with complete transparency and in plain language, of the processing of your data and of your rights under the legislation in force. The present Privacy Policy seeks to describe how, for what purpose, by whom and on what basis Mainvision collects and consequently processes your personal data.

The protection of your data is of the utmost importance to Mainvision and, in the course of time, Mainvision has endeavoured to provide itself with the most adequate technical and organizational means to defend its confidentiality. Nevertheless, we ask you, for your information, to read the Privacy Policy below carefully.

WHO WE ARE

Your data will be processed by Mainvision – Media Solutions, Unipessoal, Lda. with registered office at Avenida Marechal Gomes da Costa, 29D, 1800-255 Lisbon, registered with the Conservatória do Registo Comercial de Lisboa under the single registration and Corporate Body number 508 725 135 (hereinafter referred to as “Mainvision”).

Mainvision shall act, under the terms best defined in the General Data Protection Regulation (Regulation (EU) 2016/679 of the Parliament and of the Council of 27.04.2016) (hereinafter only referred to as “GDPR”), as the Controller, undertaking to fully comply with the legislation in force at all times.

WHAT IS PERSONAL DATA?

Personal data is any information, of whatever nature and whatever its medium, including sound and image, which is capable of identifying a natural person, directly or indirectly, in particular by reference to an identification number or to more specific factors of his or her physical, physiological, mental, genetic, economic, cultural or social identity. Data is considered personal when it allows any person to relate the information to a specific person, even if the person or entity holding the mentioned data is not capable of establishing such a link.

HOW AND WHAT DATA WE COLLECT

Usually, personal data is requested when the data owner registers on the website, requests contact and/or newsletters, subscribes to a certain service, participates in an event run by Mainvision or managed by Mainvision, or enters into a contractual relationship with Mainvision.

During our activity, we collect and process personal data in several ways. In addition to collecting personal data that the data owner provides directly to us, we may collect data by recording how you interact with our services, for example by subscribing to newsletters on our website.

Your data is also collected through a consent form which you expressly fill in for the purposes of processing personal data.

The data collected by Mainvision are, as the case may be, the following: (i) full name; (ii) date of birth; (iii) gender; (iv) address (and shipping address, if different from the address); (v) e-mail; (vi) mobile phone number; (vii) tax identification number; (viii) image; (ix) CV; (xi) professional activity data.

In addition to the above mentioned, the provision of personal data (such as full name, e-mail, telephone, nationality, date of birth, place of birth, gender, address, post code, city, tax identification number, educational skills, whether or not you are a student, professional experience, availability of working hours, the position for which you are applying, CV and covering letter) will also be required for the purposes of applying to Mainvision.

FOR WHAT PURPOSE AND ON WHAT BASIS WE PROCESS YOUR DATA

Under the provisions of the GDPR, the processing of personal data is only lawful if it is supported by any of the legal grounds expressly provided for therein. Depending on the purpose for which we process your data, the legal ground for processing your data may be:
– Our legitimate interest, best exemplified above;
– Your consent, e.g. for marketing purposes;
– The execution of a contract;
– Legal basis.

Your personal data is processed only for the purposes communicated to you and is not used for any other purpose.

The data collected is also necessary for the proper provision of the services contracted and the adequacy of the services to the needs and interests of the users.

Without prejudice to the provisions of Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 (E-Privacy Directive), where we have obtained your prior, free, explicit and informed consent, Mainvision may collect and use your data for marketing purposes by sending you information about services, campaigns or promotions carried out by Mainvision. If you accept this, you will receive marketing communications by e-mail. You may at any time object to this data processing. Your consent is essential for Mainvision to process your personal data for these purposes; however, if you choose not to give your consent, your visit and use of our website will not be affected.

Mainvision will also process your data, for example, when it has a legitimate interest to do so, in particular for: (i) developing and maintaining our website; (ii) providing technical assistance; (iii) preventing and detecting fraud; (iv) ensuring network and information security; (v) registering and managing events and conferences.

In addition to the above, personal data, where applicable, will also be processed for the purpose of recruitment. The legal basis for the processing of these data is a legal obligation and the execution of a contract or pre-contractual steps.

Mainvision assumes that the data collected have been entered by the data owner and/or authorised by him/her or the holders of parental responsibilities and that the data are true, up-to-date and accurate.

Mainvision does not adopt automated individual decisions, including profiling, which produce effects on its legal sphere or significantly affect it in a similar manner.

HOW WE PROTECT YOUR DATA

Personal data is processed with the legally required level of protection to ensure their security and prevent their change, loss, processing or unauthorised access, taking into account the state of technology, with Mainvision requiring the same measures from its subcontractors.

To this end, Mainvision uses several security techniques, including encryption and authentication tools, in order to seek to guarantee the maximum protection, integrity and security of your personal data.

Mainvision submits its security systems and policies to periodic reviews in order to ensure that the data is safe and protected. However, the transmission of information via internet is not completely secure and we cannot guarantee, in any event, the absolute security of the information transmitted via our website and there is a risk that it may be viewed and used by unauthorised third parties.

WHO WE SHARE YOUR DATA WITH

For the purpose of delivering the development of our website or streaming platforms Mainvision will allow trusted third parties with whom we have entered into a data processing agreement to have access to your personal data. Mainvision may also share your information when it uses third parties to provide certain services to it as such third parties may need access to your personal information. In fact, your personal data will be processed by the following categories of people in charge of the processing: event and conference organisers, people authorised to manage and/or maintain electronic media and data security measures, or those responsible for the storage and management of consents for the use of personal data.

Any subcontractor of Mainvision will process the personal data of our users in the name and on behalf of Mainvision under the strict obligation to follow our instructions.

Mainvision shall ensure that such subcontractors provide sufficient guarantees to implement appropriate technical and organizational measures so that the processing will meet the requirements of the applicable law and ensure the security and protection of the rights of the data owners in accordance with the terms of the subcontracting agreement concluded with such processors.

Mainvision will not transfer your personal data outside of the national territory, nor will it allow its subcontractors to do so.

HOW LONG WE KEEP YOUR PERSONAL DATA

Whenever there is no specific legal requirement, your personal data will be stored and kept only for the minimum period necessary for the purposes for which they were collected or further processed.

Once the maximum storage period is reached, your personal data will be irreversibly anonymised or destroyed in a secure way.

For the marketing purposes referred to in this Privacy Policy, your personal data will be kept for a maximum period of 12 months from the collection of your consent or the last contact made (whichever occurs last). Such period will apply strictly to the extent that, within this period, you have not withdrawn your consent.

The data processed for the purpose of managing your participation in events / conferences organised or hosted by Mainvision will be deleted after the end of the event / conference.

Following your contact with the several means made available by Mainvision for customer support, your data will be kept until the end of the complaints procedure or until your questions and/or requests for information have been clarified.

The data processed for recruitment purposes will be kept for a period of 5 years following the recruitment process. In the case of recruitment, the data collected within the process will be used for human resources management, to ensure compliance with legal obligations and to provide employees with the means necessary for the pursuit of their professional activity.

All the above mentioned deadlines may extend for the duration of any legal proceedings and up to six months after the transit in res judicata of the respective sentence.

YOUR RIGHTS

Mainvision takes this opportunity to inform you that, under the GDPR and as a data owner, you have the following rights:

Right of access: At any time, you may request confirmation as to whether Mainvision processes your data, access to your personal data and information on the processing thereof. In addition, you may obtain a copy of the personal data being processed;
Right to rectification: If your personal data is incorrect or incomplete, you may request that it is rectified or completed;
Right to erasure: In certain situations, you have the right to request the erasure of your personal data. This right may be limited in certain situations such as, for example, when the processing of the data is necessary for compliance with legal obligations to which Mainvision is subject or when such processing is necessary for the establishment, exercise or defence of a right in legal proceedings;
Right to data portability: Whenever the processing of the data is based on a contract to which you are a party or on your consent, you may request Mainvision to deliver to you the data you have provided in a structured, commonly used and machine-readable format. You may also request Mainvision, to the extent technically feasible, to transmit such data to other controllers.

Under certain conditions, you will also have the right to object, on grounds relating to your particular situation, to the processing of your personal data by Mainvision (whenever the processing of the data is based on the legitimate interest of Mainvision or when the data is processed for purposes other than, but compatible with, those for which the data was collected) or to request restriction of processing.

If the processing of your personal data depends on your consent, you are entitled to withdraw it at any time, without this affecting the lawfulness of the processing carried out until then on the basis of the consent previously given. It should also be noted that, subsequently, the processing of data which does not depend on your consent will not be affected or interrupted by the withdrawal of consent to the processing of data which is based on such a plea.

Mainvision also informs you that you may exercise your rights of access, rectification, erasure and objection by sending a written communication to the following e-mail address: mainvision@mainvision.pt.

Mainvision promises to be prompt in examining your requests and applications and undertakes to inform you of the measures then taken within a maximum period of one month. FINAL PROVISIONS

Mainvision reserves the right to change this Privacy Policy at any time. If the Privacy Policy changes, the date of the last change, available at the top of this page, is also updated.

Should the change be substantial, a notice will be placed on the website.

Any disputes arising from the validity, interpretation or execution of the Privacy Policy, or which are related to the collection, treatment or transmission of our clients’ personal data, shall be submitted exclusively to the jurisdiction of the judicial courts of the district of Lisbon, without prejudice to the applicable mandatory legal rules.
